Licensingoutofaproduct,process,technology,etc.,willfollowmuchthesameproceduresaslicensinginorsearchingforopportunities.Youwillneedtoprepareaformalpresentationtoexplainthefunctionalityandmarketabilityoftheconceptcontainingthefollowing: letterofintroduction; picturesoftheproduct; productdescription; manufacturinginformation; productvariations; productbenefits; marketresearchresults; objectivesforyourproject;and pricingbreakdown. Yourpresentationshouldbesenttothesamesourceslistedpreviouslyinthishandout(seethepreviousheadingSearchsources),andyouwouldrequestthatnamesandaddressesoflikelylicenseesbeprovidedtoyou. Determininganacceptableroyaltyrateforaproductisdifficult,asthereisnoquick-fixpercentagethatcanbeappliedasageneralmeasure.Althoughratesrangingfrom3%to8%ofnetsalesarecommon,eachlicensingagreementisuniqueandtheonlyconsensusthatmatterswithrespecttoroyaltyratesistheonethatoccursbetweenthelicensorandthelicenseeasaresultofnegotiations.Severalfactorsthatmayinfluencethepotentialroyaltyrateofalicensedproductinclude: iftheproductisalreadypatented;istheproduct"marketready";and doesthelicensorhaveatrackrecordofsuccessfulproducts.
