Implementation Act of the Convention on the Rights of the Child Promulgated a total of 10 Articles on 4 June 2014. 跳到主要內容 ::: 首頁 推動CRC CRC施行法 CRC施行法_英文版 最新消息 ::: CRC CRC施行法 兒童權利公約大事記 行政院兒童及少年福利與權益推動小組 中央兒童及少年代表團 推動兒童權利公約施行法諮詢會議 CRC施行法_英文版 2014-11-20 ImplementationActoftheConventionontheRightsoftheChildPromulgatedatotalof10Articleson4June2014.ThisActshallbeimplementedfrom20November2014.Article6amendmentannouncedon19June2019.Article1ThisActismadetoimplementthe1989ConventionontheRightsoftheChild(hereinafterthe“Convention”),tofulfillthephysicalandmentaldevelopmentofchildrenandyouthsandtosubstantiatetheprotectionandpromotionoftherightsofthechildandyouth.Article2TheprovisionsoftheConventionregardingtheprotectionandpromotionoftherightsofthechildandyouthshallhavetheeffectofdomesticlaw.Article3ThelawsandadministrativemeasurestowhichtheprovisionsoftheConventionapplyshallbeinreferencetothepurposeoftheConventionandtheinterpretationoftheConventionbytheUnitedNationsCommitteeontheRightsoftheChild.Article4AlllevelsofgovernmentauthoritiesshallexercisetheirauthorityinaccordancewiththeprovisionsoftheConventioninrelationtotheprotectionoftherightsofthechildandyouth,preventillegalinfringementontherightsofthechildandyouth,activelypromotetherealizationoftherightsofthechildandyouth.Article5Alllevelsofgovernmentauthoritiesshallberesponsibleforplanning,promotingandimplementingthemattersstipulatedintheConventionbasedonthedutiesprovidedbythecurrentlawsandshallfurtherperformreviewsofsuchtasks.Ifamatterinvolvesdutiesbyseveralauthorities,coordinationandcontactshallbecarriedoutamongtheseauthorities.Thegovernmentshallcooperatewiththegovernmentsofdifferentcountries,domesticandforeignnon-governmentalorganizationsandhumanrightsinstitutionsinordertoprotectandpromotetherealizationoftherightsofthechildandyouthprotectedbytheConvention.Article6InorderfortheExecutiveYuantoadvancetheimplementationoftasksstipulatedundertheConvention,representativesofchildrenandyouth,academics,experts,representativesofprivateorganizationsorinstitutions,andotherrelevantauthorities,shallbeinvitedtoestablishtheChildandYouthWelfareandRightsCommittee,whichshallendeavourtoholdregularmeetingstocoordinate,research,reviewandconsultonthefollowingtasks:1.EducationaltrainingandlaunchingofpublicawarenesscampaignsoftheConvention.2.SupervisionatdifferentlevelsofgovernmentensuringproperimplementationoftheConvention.3.Researchandinvestigationonthecurrentstatusoftherightsofthechildandyouthdomestically.4.Submissionofnationalreports.5.AdmissionofclaimsconcerningtheinfringementofConventionrights.6.OtherrelatedmattersconcerningtheConvention.Thenumberofabove-mentionedrepresentativesofchildrenandyouth,academics,experts,representativesofprivateorganizationsorinstitutionsshallnotbelessthanhalfofthetotalmemberparticipation.ThenumberofeachgenderforthetaskmentionedinParagraph1shallnotbelessthanone-thirdofthetotalmemberparticipation.Article7ThegovernmentshallestablishareportingsystemregardingtherightsofthechildandyouthandshallsubmititsfirstnationalreportwithintwoyearsfromtheimplementationofthisAct.Thereafter,nationalreportsshallbefiledeveryfiveyears.Relevantacademicexpertsandrepresentativesfromprivateorganizationsshallbeinvitedtoreviewthereports.Thegovernmentshallreviewandstudysubsequentpoliciesbasedontheiropinions.Article8ThebudgetrequiredfortheprotectionoftherightsofthechildandyouthintheimplementationoftheConventionbyalllevelsofgovernmentauthoritiesshallbeallocatedasaprioritybasedonfinancialstatusandshallbeimplementedgradually.Article9EachlevelofgovernmentauthorityshallprovideapriorityreviewlistregardingthelegislationandadministrativemeasuresunderitsjurisdictionbasedontheprovisionsoftheConventionwithinoneyearfromtheimplementationofthisAct.AnylawsandregulationsinconsistentwiththeprovisionsoftheConventionshallbecorrectedbyaddition,amendmentorabolition,andadministrativemeasuresshallbeimprovedwithinthreeyearsfromtheimplementationofthisAct.Thelegislation(amendment),revisionorcancellationoftheremaininglawsandregulations,andimprovementofadministrativemeasuresshallbecompletedwithinfiveyearsfromtheimplementationofthisAct.Article10ThisActshallbeimplementedfrom20November2014. ‌ 返回 ‌返回頂端
