FTCinvestigationfoundthatthepricingstructureforthe099telephoneseriesmightcontainthefollowingissuesthatmightimpedefaircompetition: (1)The"averagingpricing"tariffstructuremightinvolveunfaircompetition: Underthe099telephoneseries,everydial-outcity-to-citycallor–to-mobilenumbersischargedof60NTcentspersecond(orNT$3.6perminute).However,thecurrentchargeoncity-to-citycallsisNT$1.7everyfiveminutes,andthatoncitycall-to-mobilecallisNT$6perminute.Therefore,thepricingstructureunderthe099seriesisbelievedtousetheoverchargedfeesforcity-to-citycallstosubsidizetheshortfallsinthecity-to-mobilecalls.Whenthefixedcommunicationsmarketisyettobederegulated,city-to-citycallsremainamonopolyoftheChunghwaTelecom.Thoughthemarketforsomemobiletelecommunicationserviceshasbeenliberalized,ChunghwaTelecom''saveragingchargeforcity-to-citycallsandcity-to-mobilecallswillcauseanimpactonthefaircompetitionofmobiletelecommunicationservicesmarket. (2)Aviolationofthetelecommunicationtariffrightsandthecollectionoftariffs:Article14oftheMeasuresGoverningInterconnectionbetweenMobileNetworksstipulatesthatfixedtelecommunicationnetwork(citycalls)playtheroleasanaccessforthecommunicationsbetweenmobileandfixednetworks.Thismeansthatfixednetworksserveascommunicationaccessbetweenhigh-endlong-distance,international,ormobileinterconnections.Sincecity-callnetworkremainsamonopoly,thepricingforcity-to-mobilecallstobedeterminedbythecity-callmonopolywilldampenthemeaningofliberalizingtelecommunicationsmarket. (3)Accessbyothertelecommunicationserviceusers: The099seriesnumbercanonlylinktocity-callandmobilenetworksofChunghwaTelecom.UserofmobilesystemsindependentfromtheChunghwaTelecomnetworkscannotaccessthroughthe099seriesnumbers.Thiscouldpromptusersofothersystemstoswitchtothe099services. Inconclusion,inordertomaintainthecompetitionorderinthetelecommunicationmarket,andassurefaircompetition,theFTCmadethefollowingsuggestionsfortheMinistryofTransportationandCommunications(MOTC),thecompetentauthorityontelecommunications,asreference: (1)TheaveragingpricingsystemofChunghwaTelecom''s099seriescouldimpedefaircompetition."De-averaging"issuggestedsothatthepricingfortwokindsofcallsshallbechargedbythedifferentcostsaccordingly. (2)Thetariffandpay-collectionforthedial-outcitycallstomobilesystemsunderthe099seriesshallbedeterminedbymobilesystemoperatorsinlinewithrelatedtelecommunicationlawsinordertomaintainacompetitionmechanismofthetelecommunicationsmarket.
