iPhone在華被判禁售！蘋果：高通喪心病狂，你們繼續買

高通和蘋果的互撕大戲再度上演。

近日，美國高通公司以蘋果公司侵犯其專利為由，要求對蘋果實施銷售禁令，並隨後得到了中國福州市中級人民法院的批准。

A Chinese court ordered a ban in the country on iPhone sales in a patent dispute between US chipmaker Qualcomm and Apple, according to a Qualcomm statement Monday.

美國晶片製造商高通10日發布聲明稱，針對其與蘋果公司的專利糾紛，中國一家法院已判決在國內禁售iPhone部分機型。

The statement said the Fuzhou Intermediate People’s Court had granted Qualcomm’s request for two preliminary injunctions against four subsidiaries of Apple, ordering them to immediately to stop selling the iPhone 6S, iPhone 6S Plus, iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus and iPhone X.

聲明稱，福州市中級人民法院授予了高通針對蘋果四家中國子公司提出的兩個訴中臨時禁令，要求他們立即停止銷售iPhone 6S、iPhone 6S Plus、iPhone 7、iPhone 7 Plus、iPhone 8、iPhone 8 Plus和iPhone X。

據了解，這次的禁令不包括蘋果的最新機型：iPhone XS、iPhone XS Max和iPhone XR。

CNN報導稱：

The phones covered by the ban make up about 10% to 15% of current iPhone sales in China, according to Daniel Ives, analyst at Wedbush Securities.

韋德布希證券公司分析師丹尼爾·艾維斯稱，禁令所涵蓋的機型占目前iPhone在中國銷量的10%到15%。

該案所涉專利使消費者能夠調整和重設照片的大小和外觀，以及在手機上瀏覽、尋找和退出應用時通過觸摸屏對應用進行管理。

The chipmaker is alleging patent violations on features that let users reformat the size and appearance of photos and manage applications on a touchscreen when navigating through phone apps.

高通執行副總裁兼總法律顧問唐·羅森伯格（Don Rosenberg）稱：

「Apple continues to benefit from our intellectual property while refusing to compensate us. These court orders are further confirmation of the strength of Qualcomm’s vast patent portfolio.」

「蘋果一直都在占高通專利的便宜，但卻拒絕補償。

這些法律禁令進一步證明了高通龐大專利組合的優勢。

《華爾街日報》稱，這是中國首次在國內禁售iPhone：

The Nov. 30 decision by a Chinese court is the first in the world's largest smartphone market that seeks to curtail iPhone sale in the country.

中國法院11月30日的這一判決，是中國這一全球最大手機市場第一次尋求在國內禁售iPhone。

蘋果：高通喪心病狂，你們繼續買

禁令一出，蘋果立刻表示不服，要上訴。

Apple on Monday filed a request for the court to reconsider its decision.

蘋果10日向法庭發起上訴，請求對判決進行重新考慮。

蘋果稱高通此舉「喪心病狂」（a "desperate move"），自己的底子都不乾淨……

"Qualcomm's effort to ban our products is another desperate move by a company whose illegal practices are under investigation by regulators around the world." Apple said.

蘋果說，「高通企圖禁售我們的產品，這只不過是他們又一次喪心病狂的舉動，這家公司自己的非法行為都還在被世界各地的監管機構調查。

」

蘋果表示並沒有侵犯高通的專利：

Apple added that Qualcomm 「is asserting three patents they had never raised before, including one which has already been invalidated.」

蘋果補充說，高通「所聲稱的三種專利，他們從未申請過，其中的一種還已經被宣布無效。

」

此外，蘋果還稱，相關專利並沒有被應用在最新作業系統中，中國消費者還能繼續買。

"All iPhone models remain available for our customers in China."

中國消費者仍可以購買到所有型號的iPhone手機。

彭博社援引相關分析師的話表示，此禁令的影響範圍有限，雖然確實是蘋果的新聞風險（headline risk），但不能根本上改變蘋果公司在中國的業務前景。

摩根斯坦利的Katy Huberty表示：

「This injunction initially appears limited in its scope,」 as it only applies to phones with the iOS11 operating system.

「這項禁令首先影響是有限的，」因為它僅適用於iOS11作業系統的手機。

「Currently, 70 percent of Apple’s device installed base operates iOS12 (21 percent operates iOS11 and 9 percent operate an older OS) and, more importantly, all devices are currently sold with iOS12.」

「目前，蘋果70%的手機裝的都是iOS12的系統（21%安裝的是iOS11，其餘9%是更久遠的iOS系統）。

更重要的是，目前所有售賣的系統都安裝iOS12。

儘管如此，這次禁令也讓蘋果的股價遭受到一些衝擊，這可能影響蘋果在中國本來就已經顯現出頹勢的銷量：

Despite that, the ruling 「does add to greater headline risk for the stock and we need to monitor any impact on consumer demand for Apple products in China, which is already weak.」

周一截至美東時間下午2點46分，蘋果股價由跌轉漲，上漲0.7%，此前下跌超2%，高通股價上漲2.68%。

上周五，蘋果股價今年轉跌，本季度已下跌26%。

不過，《華爾街日報》則認為，這一判決出現中美貿易摩擦的大背景下，使得蘋果未來在中國這一關鍵市場的不確定性增加（casting uncertainty over Apple's business in a critical market amid thorny trade relations between the U.S. and China）。

高通「手撕」蘋果，什麼仇什麼怨？

據澎湃新聞早前引用彭博社的報導，這項裁決是高通、蘋果兩家美國公司之間，就高通收取的專利許可費有關的全球爭議的一部分。

Apple and Qualcomm are suing each other in courts across the world. Billions of dollars are at stake, and each side has claimed some victories.

蘋果和高通在全世界範圍內相互起訴，涉及金額數十億美元。

各方都取得過一些勝利。

多年來，高通一直與蘋果存在著法律糾紛。

高通指控蘋果侵犯專利，即當用戶在瀏覽手機應用程式時，可以對照片的大小和外觀重新格式化，並在觸摸屏上管理應用程式。

蘋果起訴高通則是為了迫使高通降低專利許可費。

蘋果認為，高通利用其作為智慧型手機晶片最大供應商的地位強迫手機製造商支付費用。

高通則反駁稱，蘋果公司在沒有支付費用的情況下，使用了高通的智慧財產權。

兩家鬧翻兩年，涉及訴訟數十起……

In 2017, Apple sued Qualcomm for $1 billion after the chipmaker stopped paying for the exclusive right to put its chips in iPhones. Qualcomm withheld its payments after the European Union began investigating them. The EU ultimately deemed the payments illegal, and In January 2018, the European Commission ordered Qualcomm to pay a $1.2 billion fine over the issue.

2017年，高通不再向蘋果支付使用其晶片的專利費用，蘋果後來和高通打了個10億美元的官司。

高通在歐盟開始對其進行調查後收回了支付款項。

歐盟最終認為支付是不合法的，今年1月，歐盟委員會向高通開出12億美元的罰單。

編者註：歐盟認為高通向蘋果支付費用，使得蘋果手機只能使用高通晶片違反了反壟斷法。

除此之外，在一些專利相關的事項上，二者也存在不少糾紛：

Qualcomm has asked a US federal judge to ban the sale of iPhones in one case. In June, a judge in the International Trade Commission found that Apple had violated one of Qualcomm's patents related to battery-saving technology.

在一起案件中，高通曾要求美國一名聯邦大法官叫停蘋果手機的銷售。

今年6月，國際貿易委員會的一名法官發現，蘋果公司曾侵犯高通一項關於省電技術的專利。

今年7月，高通稱蘋果將不會在iPhone中使用其數據機，高通也因此削減了其盈利預測。
