細數美國政府打壓華為的「九宗罪」

(觀察者網訊)9月3日,華為公共及政府事務部在心聲社區刊登《有關媒體報導稱美國司法部對華為展開新得調查得聲明》,該聲明提及近日美國華爾街日報報導了美國司法部針對華為進行了新的所謂竊取商業秘密刑事調查。

華為聲明表示,華為堅信自主研發的產品不侵權,並在聲明中介紹了事情前後經過以及提供詳實的材料予(附圖以其外觀設計專利為例和華為產品進行對比說明)。

華為的聲明指出,最近一段時間以來,美國政府不僅動用其政治和外交影響力,遊說各國政府禁止使用華為設備,更是動用其國家機器,濫用司法、行政權力,採用各種不正當手段騷擾、影響華為或合作夥伴的正常業務。

包括:

1、通過執法機構威脅、恐嚇、要挾、利誘、策反華為在職或離職員工為其工作;

2、以不正當的方式搜查、扣押、甚至拘捕華為員工或合作夥伴;

3、設置各種陷阱或圈套,冒充華為員工,創造案件,試圖形成對華為不利的不實指控;

4、採取網絡攻擊的方式不正當的刺探華為的內部網絡和信息系統;

5、通過FBI上門約談的方式進行施壓,要求華為員工作為內應配合獲得華為信息;

6、動員和策劃與華為有商業合作或有商業衝突的公司對華為進行不實指控或釣魚;

7、搜集各類虛假的針對華為的負面報導,並以此為依據展開調查;

8、將歷史上已經解決的民事案件,以技術秘密竊取等理由,進行選擇性的刑事調查或起訴;

9、通過恐嚇、拒發籤證、扣貨等方式,阻撓正常的商業活動和技術交流。

華為屢遭不公正待遇,此番聲明可以說是用中英文詳細列出了美國政府打壓華為的「九宗罪」。

華為在聲明中表示,美國政府採取的這些惡劣行為的目的無非是希望將華為抹黑為通過盜竊他人商業秘密發展起來的公司,打擊和限制華為的全球領先地位。

我們對此堅決反對。

8月30日,華爾街日報報導了美國司法部針對華為進行所謂竊取商業秘密刑事調查,有關該報導提及的Oliveira等事件和美國政府近期的調查行為,華為嚴正聲明如下:

2014年5月28日,在葡萄牙公民Rui Pedro Oliveira主動要求下,華為美國子公司人員與其進行了一次短暫會晤,會上Oliveira先生主動推銷其伸縮攝像頭設計方案。

華為並未使用Oliveira先生的設計方案。

2017年,華為開始銷售自主研發的EnVizion360全景攝像頭,而華為的研發團隊從未接觸過源於Oliveira先生的信息。

華為的設計方案是不可伸縮、帶兩側魚眼鏡頭的全景攝像頭,與Oliveira先生可伸縮的單側鏡頭的非全景攝像頭設計方案完全不同。

從2018年4月到2019年3月,Oliveira先生通過郵件聲稱華為公司的EnVizion360攝像頭侵犯其所持有的美國專利,並多次威脅如果華為不支付其高額費用,將通過媒體和政治途徑給華為施加壓力。

華為堅信自主研發的產品不侵權,並提供了詳實的材料予以證明(附圖以其外觀設計專利為例和華為產品進行對比說明),但Oliveira先生繼續通過媒體扭曲事實、抹黑華為,甚至試圖通過其政府高層給華為施壓使華為屈服並支付其高額費用。

在不堪其擾的情況下,為維護華為的聲譽及合法權益,2019年3月26日,華為先行向美國法院提出請求確認未使用Oliveira專利,這本是一個非常普通的民事訴訟程序,但Oliveira先生拒絕接受法庭傳票的送達,拖延參與美國法庭程序。

這種明顯的利用當前的國際政治環境、通過媒體歪曲事實,進行投機的行為,不應被鼓勵,更不應成為美國司法部刑事調查的事由。

一段時間以來,美國政府不僅動用其政治和外交影響力,遊說各國政府禁止使用華為設備,更是動用其國家機器,濫用司法、行政權力,採用各種不正當手段騷擾、影響華為或合作夥伴的正常業務。

事實上,所有這些所謂的刑事案件,沒有涉及任何一項核心技術,也沒有足夠的事實和證據支撐其指控。

美國政府採取的這些惡劣行為的目的無非是希望將華為抹黑為通過盜竊他人商業秘密發展起來的公司,打擊和限制華為的全球領先地位。

我們對此堅決反對。

華為的發展,得益於三十年的持續的研發投入和全球十八萬員工的持續努力,得益於客戶、供應商和合作夥伴對我們的信任和支持。

世界上沒有任何一家企業可以通過「偷竊」成為全球領先的高科技企業。

附:Oliveira外觀設計專利和華為Envizion360攝像頭對比,兩者明顯不同:

1、Oliveira外觀設計是單向鏡頭伸縮,只有一側有鏡頭。

2、華為是兩側均有鏡頭,不能伸縮,具有Oliveira所沒有的大弧面。

Media Statement Regarding Reported US DoJ Probes into Huawei

On August 30, 2019, the Wall Street Journal reported that the U.S. Department of Justice probed Huawei on alleged theft of smartphone-camera patents. These allegations are false. Huawei would like to issue the following clarifications regardingthese claims, as well asrecent probes by theU.S. government mentioned in the Wall Street Journal'sreport:

On May 28, 2014,representatives from Huawei's U.S. subsidiary met with Mr. Rui Pedro Oliveira per his request. Atthe meeting, Mr. Oliveira pitchedhiscamera design, which he alleged to have U.S. patent pending, to Huawei. Huaweidid not usehis design.

In 2017, Huawei started to sell EnVizion 360 panoramic camera, independently designed and developed by Huawei’s employees having no access to Mr. Oliveira’sinformation. Unlike Mr. Oliveira’s single-lens and expandable design, Huawei’s camera was non-expandable, featured lenses on both sidesdesigned for panoramic pictures.

Beginning inApril 2018 and continuing throughMarch 2019, Mr. Oliveira began e-mailing Huawei, claiming that the EnVizion360 had infringed hisU.S. patents. In his e-mails, he repeatedly issued threats, saying that if Huawei did not pay an extortionate amount of money,he would go to the media and exert pressure through political channels.

Huawei categorically rejects Mr. Oliveira's claims of patent infringement, and has provided detailed documents in support of its stance(see visual comparisons of the two products below as example). Nevertheless, Mr. Oliveira proceeded to feed a false narrative to the media in an attempt to tarnish Huawei's reputation. Hemade further efforts to exert pressure on Huawei through senior government officials, trying to make the company cede to his demands and hand over large sums of money.

On March 26, 2019, in order to defend the company'sreputation and protect itslegitimate rights and interests, Huawei filed a complaint against Mr. Oliveira before U.S. court for a declaration of non-infringement of Mr. Oliveira's U.S. patents. This isa normalcivil procedure. However, Mr. Oliveira declinedto accept the service of Huawei’s complaint and summons, resulting in delaying of the court proceedings.

It's clear that Mr. Oliveira is taking advantage of the current geopolitical situation. He is pushing a false narrative through the media in an attempt to capitalize on a dispute.This type of behavior should not be encouraged, nor should it be considered rational justification for a criminal investigation bythe U.S. Department of Justice.

For the past several months, the U.S. government has been leveragingitspolitical and diplomatic influence to lobby other governments tobanHuawei equipment.Furthermore, it has been using every tool at its disposal – including both judicial and administrative powers, as well as a host of other unscrupulous means – todisrupt the normal business operations of Huawei and itspartners. These include:

 Instructing law enforcement to threaten, menace, coerce, entice, and incite both current and former Huawei employees to turn against the company and work for them

 Unlawfully searching, detaining, and even arrestingHuawei employees andHuawei partners

 Attempting entrapment, or pretending to beHuawei employees to establish legal pretensefor unfounded accusations against the company

 Launching cyber attacks to infiltrate Huawei's intranet and internal information systems

 Sending FBI agents to the homes of Huawei employees and pressuring them to collect information on the company

 Mobilizing and conspiringwithcompanies that work with Huawei, or have a business conflict with Huawei, to bring unsubstantiated accusations against the company

 Launching investigations based on false media reports that target the company

 Digging up old civil cases that have already been settled, and selectively launching criminal investigations or filing criminal charges against Huawei based on claims of technology theft

 Obstructing normal business activities and technical communications through intimidation, denying visas, detaining shipment, etc.

The fact remains that none of Huawei's core technology has been the subject of any criminal case brought against the company, and none of the accusations levied by the U.S. government have been supported with sufficient evidence. We strongly condemnthe malign, concerted effort by the U.S. government todiscredit Huawei and curbitsleadership position in the industry.

Huawei has invested heavily in R&D for more than 30 years. We have more than 180,000 hard-working employees around the globe. We have won the trust and support ofour customers, suppliers, and partners.

This is the source of our company's success. No company becomes a global leader in their fieldthrough theft.

Appendix: Comparison ofOliveira's design patent and Huawei's EnVizion 360 camera

1. Oliveira's design has only one single, expandable zoom lens on one side of the device.

2. Huawei's device has lenses on both sides, and they are contained in a large convex housing. Neither expand from the surface of the device.
